Terms of Service
These Terms govern access to and use of MyTradeHub, including the Trade Hub, Auction and related transaction-workflow features for permitted real-world assets. By creating an account, signing in, or using transaction features, you agree to these Terms.
1. Eligibility and authority
You must have legal capacity to use the service and to enter any transaction you pursue. You may list, offer, sell, auction, transfer or otherwise deal with an asset only if you own it or have lawful and sufficiently documented authority to act for the owner or other legally entitled party.
2. Platform role
MyTradeHub provides Trade Hub, auction and transaction-workflow technology. Unless expressly stated for a particular service, MyTradeHub is not the buyer, seller, owner, custodian, bank, escrow agent, trustee, broker, dealer, auctioneer, valuer, insurer, lawyer or other professional adviser in a user-to-user transaction. A digital workflow status does not itself transfer legal title, beneficial ownership or funds.
3. Accounts and security
You must provide accurate account information, protect your sign-in credentials, and promptly report suspected unauthorized use. Activity performed through your authenticated account may be treated as authorized by you unless applicable law requires otherwise. Partner and staff access may be restricted by organization, capability, matter assignment and administrative role.
4. Listings and Asset Passports
You are responsible for the accuracy, legality and completeness of descriptions, photographs, ownership claims, values, encumbrances, documents and other information you provide. You must disclose material information required by law and must not conceal known title, authority, condition or transfer restrictions.
Labels such as Owner Declared, Document Supported, or Professionally / Independently Verified describe the source or level of support recorded within MyTradeHub. They are not a warranty by MyTradeHub that an asset, person, document, valuation or transaction is genuine, enforceable, free of defects or suitable for a particular purpose.
5. Trade Hub offers, counters and trades
The Trade Hub may allow offers containing assets, cash and structured conditions. Users are responsible for reviewing the complete current offer before acceptance. A material change may reset or supersede prior acceptance. The legal effect of an offer, acceptance or Trade Snapshot depends on the transaction, applicable law, required formalities and any final agreements or transfer instruments.
A Trade Snapshot is intended to preserve commercial terms accepted through the platform. It does not replace notarization, registration, governmental approval, lender consent, tax filings, regulatory approvals, title instruments or other formalities that may be legally required.
6. Auctions
Participation in an auction may require identity or bidder verification, an approved bidding limit and bid security. Maximum bids may be used for automatic bidding and remain non-public. Auctions may use reserves, minimum increments, scheduled start and end times and late-bid extensions. A displayed winning bid does not by itself complete payment, settlement or title transfer.
Sellers and institutions must have lawful authority to auction the asset. MyTradeHub may restrict, pause, cancel, reopen or refuse to finalize an auction where reasonably necessary for security, fraud prevention, legal compliance, authority verification, material technical error or transaction integrity.
7. Due diligence and independent review
You are responsible for independently assessing counterparties, identity, ownership, title, encumbrances, condition, valuation, taxes, legal rights, permits, financing, sanctions, regulatory requirements and transaction risks. Where appropriate, obtain independent legal, tax, accounting, valuation, inspection, engineering or other professional advice before committing to a transaction.
8. Payments, escrow, banking, trustee and transfer services
Payment, escrow, trustee, inspection, verification, financing, banking, logistics, legal, valuation and transfer services may be provided by independent third parties. Any provider integration or partner service remains subject to that provider's own approval, terms, licensing or authorization, compliance requirements and availability. MyTradeHub does not hold itself out as providing a regulated third-party service unless that service is expressly identified and lawfully offered.
Where a MyTradeHub transaction workflow uses escrow or another third-party funds-holding service, escrow is the default settlement condition unless both transaction parties expressly agree to waive it. A unilateral waiver is ineffective. If both parties waive escrow, they accept the additional risks of direct settlement and remain responsible for the agreed payment and transfer arrangements. MyTradeHub does not itself hold transaction funds.
A trustee-supported property structure, if used, must be separately established and administered by an appropriately licensed or authorized provider and remains subject to applicable land, trust, tax, KYC/AML, registration and regulatory requirements. MyTradeHub records and coordinates workflow status; it does not itself become the trustee or transfer authority.
9. Partner organizations and professional services
Banks, lenders, trustee-service providers, real-estate firms, valuers, law firms and other professional organizations may use separate role-controlled partner workspaces. Each organization remains responsible for services performed under its own licence, registration, authority, professional engagement and internal policies. Access to one matter or capability does not create platform-wide access or appointment to another role.
10. Fees and taxes
Any platform or transaction fee will be disclosed before it becomes payable. Unless expressly stated otherwise, users remain responsible for taxes, duties, registration costs, professional fees, banking charges, transfer costs and other charges arising from their assets or transactions.
11. Prohibited activity
- Unlawful, stolen, fraudulent, counterfeit, sanctioned, restricted or prohibited assets or transactions.
- False ownership, authority, identity, valuation, document or transaction information.
- Market manipulation, sham bidding, collusive bidding or interference with fair auction operation.
- Circumvention of legal, tax, licensing, sanctions, AML, KYC or regulatory requirements.
- Malware, scraping or automated activity that harms service integrity, security or availability.
- Harassment, impersonation, infringement of third-party rights or misuse of another user's information.
12. User content
You retain rights you have in content you submit. You grant MyTradeHub a non-exclusive, worldwide licence to host, store, reproduce, process and display that content as reasonably necessary to operate, secure and promote the relevant Trade Hub listing, auction or transaction. You represent that you have the rights needed to provide that content.
13. Account and transaction controls
We may remove content or restrict, suspend or terminate accounts, listings, bidding or transaction functionality when reasonably necessary to protect users, prevent fraud or abuse, preserve transaction integrity, comply with law, respond to legal process or enforce these Terms.
14. Service availability
MyTradeHub is an evolving commercial service. Features, supported countries, currencies, transaction types and provider integrations may be added, changed, paused or removed. We do not guarantee uninterrupted availability, a particular buyer or seller, financing, settlement, verification, transfer or any specific commercial result.
15. Disclaimers and liability
To the maximum extent permitted by applicable law, the service is provided on an as-available basis and MyTradeHub disclaims implied warranties that may lawfully be disclaimed. MyTradeHub is not responsible for user-provided information, off-platform conduct, asset defects, undisclosed encumbrances, independent professional advice, third-party services or a transaction that fails to complete.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
16. Indemnity
To the extent permitted by law, you are responsible for losses, claims or costs arising from your unlawful use of the service, your breach of these Terms, your infringement of another person's rights, or materially false information or authority you provide in connection with an asset or transaction.
17. Governing law
Unless mandatory law requires otherwise, these Terms and disputes concerning use of MyTradeHub are governed by the laws of the Kingdom of Cambodia, and the competent courts of Cambodia have jurisdiction. Transaction-specific agreements may provide different governing-law or dispute terms between the relevant parties.
18. Privacy and changes
Our Privacy Policy explains how information is handled. We may update these Terms as the service develops or legal requirements change. Material changes will be posted with a new effective date and, where appropriate, renewed acceptance may be required.
